2. Definitions

● Payment Instrument: Includes credit/debit cards, bank accounts, UPI, IMPS, prepaid instruments, or other payment methods enabled by banks/financial institutions.

● Platform: Refers to the website or mobile application where the Merchant offers its products or services.

● Transaction: Any order or request placed by the User to purchase products or services from the Merchant.

● Transaction Amount: The amount paid by the User for the Transaction.

● User/Users: Any individual accessing or availing services/products via the Platform.

3. Merchant’s Rights

You agree that we may collect, store, and use the information you provide to deliver services/products and to contact you with respect to the same.

4. User Responsibilities

You agree to provide accurate, complete, and up-to-date information including personal details (e.g., name, email, address, age, gender) and valid payment details required for processing your transactions.

5. Prohibited Actions

You agree not to:

● Use the Platform for unauthorized or unlawful purposes.

● Systematically extract data to build databases without permission.

● Misuse the Platform’s services or engage in fraudulent activities.

● Attempt to gain unauthorized access to user accounts or our systems.

● Disrupt Platform functionality using malicious software or automated scripts.

● Post abusive, harassing, or false content.

● Engage in any commercial use of the Platform without our prior written consent.

● Copy, decompile, reverse engineer, or tamper with any part of the Platform.

● Violate applicable laws or regulations in your use of the Platform.

6. Limitation of Liability

In the event of a defective product or service, your sole recourse is to initiate a refund request as per the applicable policy. We are not liable for indirect or consequential losses. You agree to indemnify and hold harmless the Merchant, its affiliates, and agents from any claims or liabilities arising from your use of the Platform or violation of these Terms.

7. Reviews and Feedback

You may submit reviews, provided:

● You have firsthand experience.

● Your review is not offensive, discriminatory, misleading, or unlawful.

● You do not represent a competitor or post fake reviews.

We reserve the right to remove, edit, or moderate reviews at our discretion. By submitting a review, you grant us a perpetual, non-exclusive, royalty-free license to use the content for marketing or other purposes.

8. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of India. All disputes shall be resolved through arbitration in Bengaluru under the Arbitration and Conciliation Act, 1996. The arbitration shall be in English, and the venue shall be Bengaluru. The arbitration award shall be final and binding. Interim relief may be sought in the courts of Bengaluru.

10. Disclaimer

● Upon initiating a transaction, you agree to pay the listed price via legitimate means.

● You are responsible for safeguarding your account credentials.

● We disclaim liability for unauthorized payment instrument usage, payment failures, or system errors.

● The Platform content is for informational purposes only and should not be construed as advice.

● We do not endorse or verify third-party links or user-generated content.

● You are responsible for your own cybersecurity measures while accessing the Platform.

11. Miscellaneous

● These Terms constitute the entire agreement between you and us regarding your use of the Platform.

● Any failure to enforce any right or provision of these Terms shall not constitute a waiver.

Cancellation and Refund Policy

By completing a transaction on our Platform, you ("User") are entering into a legally binding agreement with us ("Merchant") for the purchase of products and/or services. Please read this policy carefully to understand the terms governing cancellations and refunds.

1. Cancellation Policy

● Once a Transaction is completed, cancellations are not permitted unless explicitly stated on the Platform.

● If cancellation is allowed for a particular product and/or service, it will be subject to the specific terms mentioned on the relevant product/service page.

● We reserve the sole discretion to accept or reject any cancellation request.

● We may request additional information from you to evaluate the cancellation request before arriving at a decision.

● Cancellations will not be entertained once the product has been delivered or the service has been rendered, except in cases where the product or service does not match the description provided on the Platform.

2. Refund and Replacement Policy

● Refunds or replacements will only be entertained if the delivered product or service materially deviates from the description provided on the Platform.

● Requests for refund or replacement must be submitted within three (3) days from the date of the Transaction or within the timeframe specified on the Platform (but never less than three days).

● To initiate a refund request, you must:

○ Raise a ticket via email to info@invictusone.com

○ Provide a clear and specific reason for the refund request.

○ Include any supporting evidence (photos, screenshots, etc.) that substantiate the claim and indicate which specific terms were violated.

3. Evaluation and Approval

● All refund or replacement requests will be evaluated by our team.

● Approval of any such request shall be at our sole discretion.

● We reserve the right to request further details or clarifications from you before processing the request.

● If your refund is approved, it will be processed through the original payment method within a reasonable time frame as communicated to you.

4. Non-Refundable Situations Refunds

Will not be issued in the following circumstances:

● Change of mind after a successful purchase.

● Delay in delivery due to factors beyond our control (e.g., force majeure, courier delays).

● Dissatisfaction due to subjective preferences not related to product/service description (e.g., taste, style, etc.).

● Failure to submit a request within the designated refund period.
